AvidTrips, Inc. ("Avid") owns and operates an online marketplace for adventure travel, which is located at www.avidtrips.com ("Website").  We list adventure trips (and other adventure travel related equipment, products and services) that are offered by tour or trip operators or other third party travel service providers and vendors (each a "Third Party Provider").  We take ensuring the security and confidentiality of the personal information you provide to us very seriously.  Below, please find our privacy practices for users of our Website.  By visiting our Website, you are accepting the practices described herein ("Privacy Policy").

What information do we collect from you?
- In General.  We receive and store any information that you enter on our Website or give us in any other way.  This includes information that can identify you ("personal information"), including your first and last name, telephone number, postal and e-mail addresses, gender and date of birth.  We also may request information relevant to your adventure activity such as weight, height, and experience.  You can choose not to provide information to us, but in general some information about you is required in order for you to complete a traveler profile, write a review, purchase a trip (or other products and services), participate in a survey, contest, or sweepstakes, submit a question to a Third Party Provider or to Avid, or initiate other transactions on our Website.

- Passenger Information.  When you make travel or other arrangements for someone else through the Website, we will request personal information and relevant adventure activity information about that individual.  You should obtain the consent of other individuals prior to providing Avid with their personal information and preferences, as any access to view or change their information will be available only through your Website account unless they also created a profile.

- Automatic Information.  We automatically collect some information about your computer when you visit the Website.  For example, we will collect your IP address, and referring website.  To help us debug problems with our software, we may collect some technical information from your browser software (such as Mozilla Firefox or Internet Explorer), screen resolution and the website that referred you to us.

We also may collect information about your online activity at the Website, such as trips viewed and purchases made.  One of our goals in automatically collecting this information is to help customize your user experience by showing you recommended trips based on your previous purchases, interests and search behavior.

Cookies and Other Web Technologies.  When you visit the Website we may store information about your web session and assign you one or more "cookies".  For example, we may record your password in this cookie file, if you checked the box entitled "Save this password for automatic sign-in" so that you do not need to log in every time you visit our Website. 

Our cookie files remain on your computer's hard drive until you delete them manually using your browser or operating system software.  You can enable your browser to refuse cookies, but doing so may disable access to some services and tools that we offer. 

From time to time, Avid may serve ads to the Website and/or permit third-party advertisers to serve ads at the Website.  In connection with serving ads, Avid and its advertisers or advertising networks will collect non-personal information from our Website users, unless you specifically permit such collection (such as, for example, through an opt-in mechanism). 

By using the Website, you are consenting to have your personal information transferred to and processed in the United States.

Payment Information.  Avid currently uses third party services for processing payments for trips and other products and services purchased through the Website and currently does not directly collect that information.  However, to complete the purchase of any trip or other products and services, you will be required to provide such information (e.g., credit card, debit card or other payment account information) to the payment processor, which we have authorized to use such information only for the purposes of completing your requested transaction.

How do we use your information?
We use other information about you for the following general purposes:
(a)    to provide you with the products and services you request; to provide you with travel confirmation and updates; to manage your account, including processing bills and providing travel notifications;
(b)    to communicate with you in general;
(c)    to respond to your questions and comments;
(d)    to measure interest in and improve our products, services, and Web site; to notify you about special offers and products or services that may be of interest to you;
(e)    to otherwise customize your experience with Avid; to solicit information from you, including through surveys; to resolve disputes, collect fees, or troubleshoot problems;
(f)    to prevent potentially prohibited or illegal activities;
(g)    to enforce our Terms of Use; and
(h)    as otherwise described to you at the point of collection.

Avid also offers a communication service that allows members to communicate with each other and Third Party Providers through the Website (without communicating individual email addresses).  Avid uses your personal information (e.g., your email address) to facilitate these communications, but does not provide that information to the Third Party Provider or other member.

What about trip reviews and other user content?
Avid offers a Website service that allows members to communicate with other members generally or travelers on a particular trip (in accordance with each member’s individual communication settings).  By setting your preferences to permit other members to communicate with you on our Website, you agree to share information with those other members and acknowledge that certain personal information will be viewable by those other members.  The information available to the other members will be as disclosed on your profile page.  Therefore, you control which information will be shared in this circumstance.  For example, if you provide your real name, address, gender and age on your profile page, then that information will be available to other members.  Once disclosed according to your preferences, Avid cannot control the actions of other members with whom you may choose to share information or communicate.  You also may post reviews of trips or Third Party Providers that will be viewable by others.  You understand that even after removal, copies of your reviews and other personal information shared with other members may remain viewable in cached and archived pages or if other members have copied or stored that information.

Who do we share your information with?
Avid may share your information with the following entities:
Third Party Providers: Avid shares your name, email address, postal address, telephone number, gender and age and, when applicable, other personal information relevant to your adventure activity (such as weight, height, and experience) with Third Party Providers only after you purchase a trip or other products or services from that Third Party Provider. Until the purchase, we facilitate an anonymous communication between you and the Third Party Provider.  Although we require that Third Party Providers use your personal information only for the purpose of booking and communicating with you regarding the specific trip purchased by you, and conducting the trip or otherwise delivering the products or services you ordered, we encourage you to review the privacy policies of any Third Party Provider whose products and services you purchase through the Website.

Third-party vendors: These are vendors who provide services or functions on our behalf, including payment processing, web hosting, business analytics, customer service, marketing, distribution of surveys or sweepstakes programs, and fraud prevention.  These companies have access to personal information needed to perform their functions but are not permitted to share or use the information for any other purpose.

Business partners: There may be business partners with whom we may work with, to jointly offer products or services or to facilitate log-in to your Avid account and sharing of other social network information on this Website.  Although we work with responsible third parties, their business policies may include different privacy policies and practices than we have.  Therefore, when you click through to third party websites, our Privacy Policy no longer applies.  We encourage you to read the privacy policies of these partner websites.

Legal Situations: We also may share your personal information in response to subpoenas, court orders, or other legal process; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law.  In such cases we reserve the right to raise or waive any legal objection or right available to us.  We may also share your information in connection with a corporate transaction, such as a divestiture, merger, consolidation, or asset sale to allow the purchaser to continue to operate the Website and to provide you with adventure travel services, or in the unlikely event of bankruptcy.

We also may share aggregate or anonymous information with third parties, including advertisers and investors, in such a way in which your identity is not reasonable ascertainable.  For example, we may tell our potential Third Party Providers the number of Website visitors or what are the most popular trip destinations.  This information does not contain any personal information and is used to develop content and services we hope you will find of interest.  We do not share your personal information with third parties for the purpose of direct marketing to you by such third parties.

Other than as set out above, you will be notified when your personal information will be shared with third parties, and you will have an opportunity to choose not to have us share such information.

How can you access and change your information?
You can view, update and change your personal information on your My Account page at the Website.  You can close your Website account by selecting the Account Closure option.  Please note that after you close an account, you will not be able to sign in or access any of your personal information.  However, you can open a new Website account at any time.  Your reviews and other content posted on our site may still be available for viewing.  Please also note that we may retain certain information associated with your Website account such as your communications with Avid or Third Party Providers for analytical purposes as well as for recordkeeping integrity.
How can you control the use of your information?
 
As discussed above, you can choose not to provide us with any information, although it may be needed to make travel purchases or to take advantage of certain features offered on the Website.

You also can add or update information on the My Account page and close your Website account as described above.

You control how your information is shared through your Website account settings page.  You can set different privacy settings for different services.  For example, you can allow everyone to see the trips you have been to in the past, but only allow those who will be attending the same trip as you are to see which trip(s) you will be going on.  You can add to and delete individuals from your buddy list anytime.

When you register as a member on the Website, you will be given a choice as to whether you want to receive e-mail messages from Avid about special offers and newsletters.  As a registered member, you can modify your choice at any time on the My Account page.  In addition, you also will be given the opportunity to unsubscribe from commercial messages in any such e-mail we send.  Please note that we reserve the right to send you other communications, including service announcements, administrative messages, and surveys relating either to your Website account or to your Website transactions, without offering you the opportunity to opt out of receiving them.

The Help portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether.  Please note that if you refuse to accept cookies from Avid, you will not be able to access portions of our Website.

How do we protect the privacy of children?
Avid does not knowingly collect personal information from people under the age of 13.  If we become aware of the fact that a child is attempting to submit this information, we will inform them that he or she is ineligible to do so.  We will then remove this information from our records.

How do we protect your information?
Avid is very concerned about safeguarding the confidentiality of your personal information.  We take appropriate physical, electronic and administrative measures to protect the Website against unauthorized access, alteration, disclosure or destruction of information.

What about links to third party sites?
We may offer links to other websites that may offer products or services that we believe may be of interest to you.  We encourage users to be aware when they leave our Website and to read the privacy policies of every website that collects personally identifiable information from them.  This Privacy Policy only applies to information collected on this Website.

How long does this Privacy Policy live?
Avid reserves the right to modify this Privacy Policy at any time.  If there are material changes to this Privacy Policy on how Avid will use your personal information, we will prominently post these changes prior to implementing them.  If you use our Website after we post these changes, this indicates your acceptance of them.
